Acceptable Use Policy
Prohibited uses
You may use our Website only for lawful purposes. You may not use our Website:
in any way that breaches any applicable local, national or international law or regulation;
in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
for the purpose of harming or attempting to harm minors in any way;
to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards;
to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam); or
to knowingly transmit any data, send or upload any material that contains viruses, trojans, worms, logic bombs, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
You also agree:
not to reproduce, duplicate, copy or re-sell any part of our Website in contravention of the provisions of our Terms of Use; and
not to access without authority, interfere with, damage or disrupt: any part of our Website; any equipment or network on which our Website is stored; any software used in the provision of our Website; or any equipment or network or software owned or used by any third party.
Not to attack our Website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Website will cease immediately.
User Content
Visitors may post reviews, comments, ratings, and other content; and submit suggestions, ideas, comments, questions or other information (‘interactive services’) so far as the content conforms to the content standards.
We will do our best to assess any possible risks for users from third parties when they use any interactive service provided on our Website, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our Website, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.
The use of any of our interactive services by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use an interactive service that it is important that they communicate with their children about their safety online, as moderation is not fool proof. Minors who are using any interactive service should be made aware of the potential risks to them.
If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
Content Standards
These Content Standards apply to any and all material which you contribute to our Website (‘Contribution’), and to any interactive services associated with it.
The Content Standards must be complied with in spirit as well as to the letter. The standards apply to each part of any Contribution as well as to its whole.
Natural Catch Tuna will determine, in its discretion, whether a Contribution breaches the Content Standards.
A Contribution must:
be: accurate; honest; and comply with the law applicable in the United States of America and in any country from which it is posted.
not: be deceptive, defamatory, obscene, offensive, hateful or inflammatory; promote sexually explicit material, violence, illegality, discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; be threatening, abusive or invasive of privacy, likely to harass, upset, embarrass, alarm, cause annoyance or inconvenience or needless anxiety.
not infringe any copyright, database right or trademark of any other person; breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence; or be in contempt of court. It should not contain any advertising or promote any services or web links to other sites.
Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
You should not impersonate any person, or misrepresent your identity or affiliation with any person or give the impression that the Contribution emanates from Natural Catch Tuna if this is not the case.
Breach of the Terms of Use
When we consider that a breach of this Acceptable Use Policy and the Terms of Use has occurred, we may take such action as we deem appropriate.
Failure to comply with the Acceptable Use Policy constitutes a material breach of the Terms of Use and may result in our taking all or any of the following actions:
immediate, temporary or permanent withdrawal of your right to use our Website, and/or of any Contribution uploaded by you to our Website;
legal proceedings against you, including but not limited to, proceedings for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; and
disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.
We exclude our liability for all action we may take in response to breaches of these Terms of Use. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

Resale Policy of Natural Catch
We issue this Resale Policy which applies to you and all Authorized Resellers of our products in the United States of America.
Please read this Resale Policy carefully. By purchasing our products or by establishing an Authorized Reseller account these terms apply to you. If you would like to become an Authorized Reseller please contact info@naturalcatchtuna.com.
Any person failing to comply with this Resale Policy will face immediate termination of its account, where applicable revocation of its Authorized Reseller account status, and/or further legal action. Violations of this Resale Policy may be reported to the Natural Catch at 1-888-841-7139.
You and Authorized Resellers shall only use or sell our products solely to End Users of the products. An “End User” is a purchaser of the products who is the ultimate consumer of the products and who does not intend to re-sell the products to any third party. Neither you nor any Authorized Resellers shall sell or transfer any of the products to any person or entity for which it is known, or there is reason to know, that it intends to re-sell the products.
Other than sales on sites expressly permitted by us, neither you nor Authorized Resellers are permitted to market for sale or sell our products on the Internet without an express written agreement with Natural Catch allowing such conduct. The prohibition on marketing for sale and selling our products on the Internet does not preclude you or Authorized Resellers advertising on websites owned by you or the Authorized Resellers, and/or social media accounts, that products are available for purchase in brick-and-mortar selling locations. Provided, however, the advertising of prices on your website or the websites of Authorized Resellers and/or social media accounts is prohibited without an express written agreement with Natural Catch allowing such conduct. Affiliate marketing activities and any marketing or advertising activity or practice that promotes or facilitates the sale of products through any website not specifically authorized herein or otherwise authorized by Natural Catch in writing also violates this Resale Policy. These prohibitions include, without limitation, third-party- facilitated retail or auction websites such as eBay, Amazon.com, Rakuten, Target.com, Walmart Marketplace or any similar website.
Authorized Resellers shall conduct their business in a reasonable and ethical manner at all times, whether engaged in the sale of Natural Catch or other products, and shall not engage in any deceptive, misleading, or unethical practices or advertising at any time, nor make any warranties or representations concerning the products except as expressed or authorized by Natural Catch.
Authorized Resellers shall comply with all instructions provided by Natural Catch regarding the storage, handling, shipping, disposal, or other aspect of the products, including instructions provided on product labels. Promptly upon receipt of our products, Authorized Resellers shall inspect our products for damage, defect, broken seals, evidence of tampering, or other nonconformance (a “Defect”). If any Defect is identified, Authorized Resellers must not offer the product for sale and must promptly report the Defect to Natural Catch at info@naturalcatchtuna.com. Authorized Resllers shall inspect their inventory regularly for expired or soon- to-be expired products and shall remove those products from its inventory. Authorized Resellers shall not sell any products that are expired.
To ensure the safety and well-being of the End Users of the products, Authorized Resellers shall cooperate with Natural Catch with respect to any product recall or other consumer safety information dissemination efforts. Authorized Resellers shall cooperate with Natural Catch with respect to any product tracking systems implemented by Natural Catch.
Authorized Resellers shall sell products in their original packaging. Relabeling, repackaging (including the separation of bundled products or the bundling of products), and other alterations to products or their packaging are not permitted. Tampering with, defacing, or otherwise altering any serial number, UPC code, batch or lot code, or other identifying information on products or their packaging is prohibited. Authorized Resellers may not remove, translate, or modify the contents of any label or literature on or accompanying the products. Authorized Resellers shall not advertise, market, display, or demonstrate non-Natural Catch products together with the products in a manner that would create the impression that the non- Natural Catch products are made by, endorsed by, or associated with Natural Catch.
Authorized Resellers agree to professionally promote the products and obtain sufficient knowledge regarding each product kept in inventory to advise End Users on the products. Authorized Resellers must be available to respond to customer questions and concerns both before and after sale of the products and should endeavor to respond to customer inquiries promptly. Authorized Resellers shall report to Natural Catch any customer complaint or adverse claim regarding the products of which it becomes aware. Authorized Resellers shall assist Natural Catch in investigating any such complaints or adverse claims.
Authorized Resellers are granted a limited, non-exclusive, non-transferable, revocable license to use the Natural Catch brands, names, logos, trademarks, service marks, trade dress, copyrights, and other intellectual property associated with the Products (the “Natural Catch IP”) solely for the purposes of marketing and selling the products as set forth herein. This license will cease upon termination of the status of Authorized Reseller. Natural Catch reserves the right to review and approve, in its sole discretion, Authorized Reseller’s use or intended use of the Natural Catch IP at any time, without limitation. Authorized Reseller acknowledges that it owns no right, title, or interest in any of the Natural Catch IP except as granted herein.
Natural Catch reserves the right to audit and/or monitor Authorized Reseller’s activities for compliance with this Resale Policy, including, but not limited to, inspection of Authorized Reseller’s facilities and records concerning the products. If Authorized Reseller breaches or threatens to breach any provision of this Resale Policy, it is agreed and understood that Natural Catch will have no adequate remedy in money or other damages at law; accordingly, Natural Catch shall be entitled to injunctive relief and other equitable remedies, provided, however, no specification in this Resale Policy of any particular remedy shall be construed as a waiver or prohibition of any other remedies in the event of a breach or threatened breach of this Resale Policy. No failure, refusal, neglect, delay, waiver, forbearance, or omission by Natural Catch to exercise any right(s) herein or to insist upon full compliance by Authorized Reseller with Authorized Reseller’s obligations herein shall constitute a waiver of any provision herein or otherwise limit Authorized Reseller’s right to fully enforce any or all provisions and parts thereof. If any provision of the Resale Policy is held contrary to law, the remaining provisions shall remain valid.
Natural Catch reserves the right to establish an Advertised Price Policy (“MAP Policy”) that applies to all Authorized Resellers in the United States of America.
